The SEC’s Climate-Disclosure Rule: What Was Left Out, and Why No One Is Happy-Barron’s
The commission had stripped out one of the most controversial provisions of its rule, the so-called Scope 3 disclosure obligations, which would have required all but the smallest public companies to report on emissions produced by their supply chains and customer bases. Those emissions “often represent the majority of an organization’s total greenhouse gas emissions,” according to the EPA.
And yet, within hours of the adoption of the final rule, a group of 10 Republican state attorneys general sued to block the pared-down regulation, arguing that even with the changes, the climate disclosure will create an immense burden for businesses and that the SEC exceeded its authority in the rule-making endeavor.
